What are my choices after Chapter 13 was dismissed due to non- payment, b/c of job loss? No secured debt left.

Can I refile? Can I file ch. 7? I still have $20k in medical debt and am supporting 3 children. I still owe my attorney $1,200.00, (b/c of his negligence!) and he won’t see me unless I have cash in hand. I am in dire need of help, I lost my car after the dismissal, and now I have to beg rides to get to my new job, and people aren’t exactly lining up to loan me money for even an old clunker with a dismissal. I have been rejected by everyone, even though I make good money now. Any help would be greatly appreciated.

The attorney did you a disservice. He should have filed to have the case converted to a 7 if you could, at that point. I would consult another attorney on this, but…the downside is that they may charge you a large retainer, but try to work out a payment plan if your income is better now. Good luck.

Why do people think we should do away with medical malpractice?

1) Doctors make mistakes all the time. Should they not be held accountable for their mistakes?
2) Malpractice cases are RARELY won by patients.
3) Malpractice cases account for a very small percentage of overall health care costs in this country.

Why do people look at Malpractice cases as being the problem with medical care in this country? Do you think the health care lobbyists in Washington, D.C. have something to do with this? Do you think that Doctors should not be held accountable for the mistakes that they make?

Bill H, if the doctor operated on your child and left some gauze inside you would be the first inline at that lawyers office.

You think 30-40% is too much for a lawyers fee, why not instead complain about the cost of every office visit instead.

Additionally most of these lawyers charge 0 fees upfront. Lawsuits last for years, and during this time the lawyer gets nothing, he has to feed his kids and family. For like 2 years of work, he doesnt even get that much, just because he gets it in a lump sum doesnt some how undermine the work the lawyer does.

Bogus medical malpractice suits are the primary cause of the high cost of medicine. It takes the form of astronomical malpractice insurance premiums and massive legal staff required to defend and pre-empt these suits. Can anyone name a famous politician who has proposed solving this root cause of out of control medical costs?

This is not only not the primary cause of medical costs, it is not even a major cause. Bogus suits, as you say, are routinely dismissed before they cost much at all. Suits that result in actual payouts are suits with merit, resulting from doctors who did not do their duty properly. The increase in insurance premiums is also largely unrelated to payouts. It is much more driven by the performance of the securities in which the premiums are invested. To illustrate this, look at California. They instituted payout caps, but did not see the reduction in premiums the insurance companies predicted. Rather, rates went up again. If you want the problem solved, tell your elected officials to go after the insurance companies. This won’t happen, since insurance companies are huge campaign donors.

Is a malpractice suit inevitable if you become a doctor?

If you become a doctor are the odds that one day you will face malpractice great? Is there a sorce that gives a number on how many doctors are sued each year?

definately inevitible. that is why all doctors have malpractice insurance:
1: everyone makes a mistake at some point
2. we are a law-suit filing kind of country aparently

you should be able to check with the state medical board (or medical insurance board…which would be more accurate) for the statistics in your area.
