1) Doctors make mistakes all the time. Should they not be held accountable for their mistakes?
2) Malpractice cases are RARELY won by patients.
3) Malpractice cases account for a very small percentage of overall health care costs in this country.
Why do people look at Malpractice cases as being the problem with medical care in this country? Do you think the health care lobbyists in Washington, D.C. have something to do with this? Do you think that Doctors should not be held accountable for the mistakes that they make?
Bill H, if the doctor operated on your child and left some gauze inside you would be the first inline at that lawyers office.
You think 30-40% is too much for a lawyers fee, why not instead complain about the cost of every office visit instead.
Additionally most of these lawyers charge 0 fees upfront. Lawsuits last for years, and during this time the lawyer gets nothing, he has to feed his kids and family. For like 2 years of work, he doesnt even get that much, just because he gets it in a lump sum doesnt some how undermine the work the lawyer does.

i got to do a project for ethics class on a article of Medical Malpractice Lawsuit. i cant find a good article can someone help me.
There was a scandal in Las Vegas a couple months ago about a clinic that does botox injections re-using needles. Google it.

Somone close to me was the victim of medical malpractice by a VA doctor. The non-VA doctors who had to ‘clean up the mess’ as it were suggested she get a lawyer. I don’t know where to even begin with this and would appreciate any advice.
Call your local Bar Association (in the phone book) and tell them what you are looking for.

Your doctor has recommended that you undergo a Trans Urethral Resection of the Prostate – or TURP. But what exactly does that mean?
The prostate gland is a walnut-sized organ that is part of your reproductive system.

Is there a website (that doesn’t charge) that allows me to find out the my doctor has been sued for medical malpractice before I have surgery?
You usually can’t find out if a physician has been sued, but you can find if any disciplinary action has been taken against his/her license.
You don’t mention what state you’re in, so search for "[your state] Board of Medical Licensure and Supervision". Most states have websites that allow you to view this information.
For example, Oklahoma’s site is http://www.okmedicalboard.org/./display.php?content=md_search_advanced:md_search_advanced. (Try it–it’s interesting to see how many docs are on probation for drug and alcohol abuse.)

What are the legal principle applied in medical malpractice, and if their are also doctrines please include…
Generally speaking, it is treatment that is below what is considered the medically accepted standard of care, which causes injury to the patient. If there is no injury, there is no malpractice. Conversely, if the treatment results in injury, or even death, but the care provided is within what would be considered reasonable care in the medical profession, there is no malpractice.

Your doctor has recommended that you – or your child – undergo surgery to remove you or your child’s tonsils. But what does that actually mean?
Your tonsils are located in the throat at the back of your mouth – one on either side of the uvula. Together, your tonsils work to help fight infection entering the body through the mouth. They are part of your immune system.
Occasionally tonsils themselves become infected. This condition is called tonsillitis.

During an attack of tonsillitis, the tonsils can become inflamed and can cause fever and body aches. In addition, tonsillitis can increase the chance of other complicating illnesses, including:
Enlargement of the lymph nodes in the neck.
Enlargement of the tonsils causing difficulty breathing or swallowing.
Recurrent bronchitis. And other conditions caused by infection.
Medical Malpractice
In most cases, a doctor will recommended the surgical removal of tonsils only when tonsillitis becomes chronic and begins to interfere with daily life.
Luckily, in most people, the immune system is more than able to compensate for the loss of the tonsils and having them removed will not in any way weaken you. You should make sure you have spoken to your doctor about the particular reasons behind his or her recommendation.
